US Court Mandates Freedom of Abrego Garcia from ICE Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face human smuggling charges, he was held in federal detention.
In her order, the judge noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The court proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.

The court, who was overseeing his challenge to removal in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
