Michael Jordan Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to “challenge” Nascar over perceived violations of antitrust rules.
Financial Stakes and a Will to Win
Jordan shared operational insights of his racing venture, revealing he invested $40 million of his own funds into the Nascar Cup series team launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I had no fear. I believed I could take on Nascar in its entirety. I felt as far as the sport it needed to be looked at from a different view.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a franchise. This system mirrors other professional sports with independent franchises, like the Charlotte Hornets or the NFL’s Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for an hour and left the court to pandemonium, with fans and media clamoring for a glimpse or a photo of the sports legend.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan said is unlawful to keep two hands on the wheel.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are details from last September. She recounted a frantic and emotional six hours where the racing circuit informed teams they had to sign a contract extension. This agreement spanned over a hundred pages detailing pay for chartered teams and a guaranteed entry in every race.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to refuse a signature that extensive document and take the issue to court. All other teams signed the agreement.
Jordan and co-owner Denny Hamlin approached Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.
The Bottom Line: Winning
Ultimately, the resistance against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Winning.
“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, noting that he purchased another franchise last year for $28m amid the legal dispute. “So I took the plunge.”
Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, submitted in a formal letter to Nascar. She said the pressure of the signature deadline didn’t sit well.
According to her, the team founder first attempted to call and talk Nascar out of forcing signatures, but CEO Jim France refused the appeal.
“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, I have 20. If there are 30, that’s the number.”
